Unbundled Representation
How Consulting-Based Representation Works
Colorado procedural rules currently allow attorneys to advise clients on what is known as an ‘unbundled’ basis, which means that the client can consult with the attorney on an as-needed basis and receive on-going support through a legal proceeding but the attorney does not enter a formal appearance in the case. With consulting-based legal representation the attorney can assist clients with settlement negotiations, draft pleadings on their behalf and communicate with opposing counsel; however, under this model the attorney will not litigate the case at trial and the client is considered a ‘pro se’ party to the case.
Unbundled representation generally provides a lower-cost alternative to traditional legal representation in which there is an attorney of record entered in the proceeding. It is also a way to minimize conflict and resolve issues more amicably and cooperatively. This is an excellent option when, for example, a client wants independent review of an agreement reached with the opposing party in mediation or when parties to a divorce or parenting matter agree on terms on their own. Unbundled representation is also ideal when a client may need on-going and occasional support with co-parenting issues that arise from time to time following divorce or separation.
